At the conclusion of a divorce case wherein the Court determines first, whether alimony or spousal support should be awarded in the first instances, and then the nature of the alimony or spousal support as either a lump sum, rehabilitative, temporary, or permanent form of support, then in the future there may be an opportunity to either modify the support by either party depending on their change of financial circumstances.

Normally, in cases of lump sum, rehabilitative, and temporary alimony, the opportunity after the divorce to modify those types of support is not available. However, when the Court awards permanent spousal support or alimony, there is usually an opportunity to modify that support until both parties have reached retirement and/or the age on which they receive social security disability benefits. In those cases where permanent alimony is subject to modification after the divorce, the party seeking a modification needs experienced counsel or a party who is opposing a modification or termination of alimony needs experienced counsel.
