Prescription Drug Injury Claims in West Virginia: What Victims Need to Know

When a prescription medication harms instead of heals, the consequences can be life-altering. If you’ve experienced unexpected side effects or serious injury from a defective or dangerous prescription drug, you may have grounds for a product liability claim. At Webb Law Centre PLLC, attorney Rusty Webb is here to help West Virginia victims understand their rights and pursue compensation.

What Is Prescription Drug Product Liability?

Prescription drug product liability falls under a category of law that holds pharmaceutical companies accountable when their medications cause injury or death due to:

  • Defective manufacturing
  • Failure to warn about potential side effects
  • Improper labeling
  • Insufficient testing
  • Design flaws in the chemical formulation

These cases are complex and often involve multiple parties—including drug manufacturers, marketers, and even distributors. Rusty Webb leverages over 37 years of experience to hold negligent parties responsible for the harm they’ve caused.

Common Examples of Dangerous Drug Cases

While any prescription medication can potentially be defective, some drug types are more commonly linked to litigation, including:

  • Blood pressure medications causing internal bleeding
  • Weight loss or diabetes medications linked to cancer or stroke
  • Antidepressants or antipsychotics associated with birth defects or suicidal behavior
  • Cholesterol drugs causing liver damage or muscle deterioration
  • Hormonal medications with links to blood clots or breast cancer

In many cases, these drugs remain on the market for years before lawsuits prompt warnings or recalls. Rusty Webb stays updated on the latest pharmaceutical litigation trends to build strong cases for his clients.

How Do You Know If You Have a Case?

To successfully bring a prescription drug injury claim, you must demonstrate:

  • You took the prescribed drug as instructed
  • You suffered a significant injury or illness
  • The injury was caused by the medication
  • The drug manufacturer or distributor was negligent

Rusty Webb will work with medical experts, analyze the drug’s warning labels and testing history, and investigate whether others have suffered similar harm—all to support your case.

What Compensation Can You Recover?

If your claim is successful, you may be entitled to compensation for:

  • Medical bills and future treatment
  • Lost wages or loss of earning capacity
  • Pain and suffering
  • Emotional distress
  • Permanent disability or disfigurement
  • In wrongful death cases: Funeral expenses and loss of companionship

Rusty Webb fights to ensure every dollar you deserve is pursued, whether through negotiation or in the courtroom.

Charleston, West Virginia — September 6, 2025 — The Webb Law Centre, PLLC, led by attorney Charles R. “Rusty” Webb, is investigating and filing lawsuits against Roblox Corporation and Discord Inc. for their alleged failure to protect minors from sexual exploitation and online predators. The actions follow a series of lawsuits filed nationwide, including a recent 124-page complaint in the Western District of Michigan alleging that Roblox and Discord enabled predators to groom and exploit an 11-year-old girl. According to the complaint, the platforms’ defective safety design and lack of protections made children “easy prey for pedophiles,” while the companies prioritized user growth and profits over basic child safety. “These cases are not isolated tragedies — they represent a systemic failure by Roblox and Discord to implement even the most basic safeguards to protect vulnerable children,” said Rusty Webb , founding attorney of The Webb Law Centre. “Our firm is committed to holding these companies accountable for profiting from unsafe platforms while exposing children to predators.” The lawsuits highlight allegations that: Roblox allows adults to initiate private conversations with children and use in-game currency (“Robux”) to exploit them. Discord enables predators to escalate abuse by soliciting explicit photos and videos from minors, constituting child sexual abuse material. Both companies have known solutions and technologies available but have failed to adopt them, leaving children exposed to significant risks. National Scope of Litigation Roblox and Discord already face multiple lawsuits across the country, including: A California federal case filed in April 2025 by a Florida child alleging exploitation on both platforms. A state lawsuit in Louisiana filed in August 2025 alleging Roblox facilitates child sexual abuse material. Additional complaints in California and Michigan detailing similar patterns of grooming, exploitation, and data misuse involving minors. Call for Families to Come Forward The Webb Law Centre, PLLC is actively investigating additional cases involving Roblox, Discord, and other online platforms where minors have been harmed. Families who believe their children may have been exploited online are encouraged to contact the firm for a confidential case evaluation . Attorney Rusty Webb represents clients on a contingency fee basis — meaning if we don’t win, you don’t pay. There is no financial risk to families seeking justice. CHARLESTON, W.Va. — Charles “Rusty” Webb, founder of The Webb Law Centre, announced today that his firm is expanding its nationwide review of kratom-related injury and wrongful death cases following an NBC Nightly News report on a beverage containing kratom and kava root. The August 2025 NBC segment highlighted growing social media warnings about the herbal supplement “Feel Free,” which contains kava root — touted for its relaxing effects — and kratom, a plant native to Southeast Asia known for its stimulant and opioid-like effects. “Kratom is still being marketed in ways that obscure its risks,” Webb said. “The NBC investigation underscores what the FDA’s been warning about — there are serious safety concerns without proper education, and people need to understand their legal options if they’ve been harmed.” The U.S. Food and Drug Administration has issued multiple warnings about kratom’s potential to cause addiction, liver damage, and death. Webb’s firm is currently reviewing cases involving: Fatal overdoses linked to kratom use Severe addiction requiring medical treatment Organ failure or other life-threatening complications Health care professionals or whistleblowers with relevant information With more than 30 years of legal experience in high-stakes toxic tort and product liability claims, Webb was one of the first attorneys to formally launch a coordinated litigation strategy targeting kratom manufacturers and distributors earlier this year. “The parallels to early opioid litigation are striking,” Webb said. “These cases can protect consumers and prevent another public health crisis.” About Rusty Webb Rusty Webb is the founder of The Webb Law Centre in Charleston, West Virginia. He has served in the West Virginia House of Delegates and has represented individuals and communities in precedent-setting complex tort, environmental, and public interest litigation. CHARLESTON, W.Va. — Charles “Rusty” Webb, founder of the Webb Law Centre, is stepping into the national spotlight as one of the first attorneys to formally launch a litigation strategy focused on kratom—a controversial botanical compound tied to addiction, organ damage, and fatal overdoses. As kratom continues to be sold widely in gas stations and online, the FDA has stepped up its scrutiny, issuing multiple public health warnings and cracking down on manufacturers for deceptive marketing and unapproved claims. With mounting injuries and fatalities, Webb believes kratom may become the next mass tort litigation wave—comparable to early opioid lawsuits. “Kratom is marketed as ‘natural’ and ‘safe,’ but many of the same red flags we saw in opioid cases are here again,” said Webb. “It’s time to hold these companies accountable.” National Legal Review Underway The Webb Law Centre is now reviewing kratom-related injury cases nationwide. The firm is accepting inquiries from: Families impacted by fatal overdoses involving kratom Individuals experiencing severe addiction or organ failure Healthcare professionals and whistleblowers Attorneys seeking co-counsel relationships on emerging kratom litigation With more than 30 years of legal experience and a background in high-stakes toxic tort and product liability claims, Rusty Webb is well-positioned to lead this emerging legal front. “We’ve seen firsthand what happens when dangerous products are allowed to spread unchecked,” Webb said. “We won’t let history repeat itself.” About Rusty Webb Rusty Webb is a nationally recognized trial lawyer based in Charleston, West Virginia. He has served in the West Virginia House of Delegates and has litigated precedent-setting injury cases throughout the region. Webb is known for his work in complex torts, environmental cases, and public interest litigation. Media Contact Webb Law Centre 714 Venture Drive, Charleston, WV 25309 www.webblawcentre.com
